This Wellness Participation Waiver is provided for informational purposes only.

The terms outlined below apply only to individuals who choose to register for and participate in a Practice by Erica event or experience, and only once this waiver has been explicitly accepted during the event registration or ticket purchase process.

Simply viewing or reading this waiver on the Practice by Erica website does not constitute agreement or acceptance of its terms.

Applicability of This Waiver

This Waiver becomes effective only when a participant:

  • registers for a Practice by Erica event, class, or experience; and

  • confirms acceptance of this Waiver as part of the registration or checkout process.

This Waiver does not apply to individuals who are browsing the website or reviewing this document for general information purposes only.

Wellness Participation Waiver & Release of Liability

This Wellness Participation Waiver and Release of Liability (the “Waiver”) applies to individuals who voluntarily participate in a wellness experience offered by Practice by Erica (“PBE”), including its founders, facilitators, contractors, partners, and collaborators, which may include hosting venues such as Vogue Hotel Montreal (collectively, the “Released Parties”).

1. Nature of the Activity

I understand that I am voluntarily participating in a wellness experience which may include, but is not limited to, sound baths, meditation, breathwork, gentle movement, stillness practices, and other sensory-based experiences (the “Activity”).

I acknowledge that these practices are intended to support relaxation, self-awareness, and well-being and are not a substitute for medical advice, diagnosis, or treatment.

2. Assumption of Risk

I understand that participation in the Activity involves inherent risks, including but not limited to physical, emotional, psychological, or sensory responses. I voluntarily assume all such risks and agree that I participate at my own discretion and responsibility.

I acknowledge that I am responsible for listening to my body and agree to discontinue participation at any time should I experience discomfort, pain, dizziness, emotional distress, or unease of any kind.

3. Health Representation

I represent and warrant that:

  • I am physically and mentally capable of participating in the Activity;

  • I have no medical condition, injury, or limitation that would prevent safe participation, or I have consulted with a qualified healthcare professional prior to participating;

  • I understand that I am responsible for my own health and well-being before, during, and after the Activity.

4. Release of Liability

To the fullest extent permitted by law, I hereby release, waive, and discharge the Released Parties from any and all claims, demands, actions, damages, losses, or liabilities arising out of or related to my participation in the Activity, including claims arising from ordinary negligence.

This release does not apply to gross negligence or willful misconduct.

5. Indemnification

I agree to indemnify and hold harmless the Released Parties from any claims, damages, or expenses (including reasonable legal fees) arising from my participation in the Activity or my breach of this Waiver.

6. Media & Photography Consent (Optional)

I acknowledge that photographs or video may be taken during the Activity. By participating, I grant permission for such content to be used by Practice by Erica and its collaborators for marketing, promotional, or educational purposes, without compensation.

If I do not wish to be photographed or recorded, I understand that it is my responsibility to notify the facilitator prior to the Activity.

7. Governing Law

This Waiver shall be governed by and construed in accordance with the laws of the Province of Québec.

8. Acknowledgement

By completing registration for a Practice by Erica event and accepting this Waiver during checkout, I confirm that:

  • I have read and understood this Waiver;

  • I accept its terms freely and voluntarily;

  • I understand that this Waiver is binding upon me and my heirs, executors, and assigns.
